UNHCR's recommendations to the Belgian Presidency July to December 2010

The recommendations seek to capitalize on the Belgian Presidency's commitment to prioritize asylum in the area of Justice and Home Affairs and to utilize the recent and expected developments in the area, such as the adoption of the Lisbon Treaty and the Stockholm Programme and the establishment of a European Asylum Support Office, to make progress on the asylum legislation and practical cooperation.

UNHCR's Recommendations to Spain for its European Union Presidency

Spain is the first country to take up the rotating Presidency after the entry into force of the Lisbon Treaty. With this Treaty come new opportunities in the area of asylum and refugee protection. The Treaty commits the EU to establish a common asylum procedure and uniform status of asylum and of subsidiary protection.

The integration of refugees is a dynamic and multifaceted two-way process which requires efforts by all parties concerned, including a preparedness on the part of refugees to adapt to the host society without having to forego their own cultural identity, and a corresponding readiness on the part of host communities and public institutions to welcome refugees and meet the needs of a diverse population.

Protection Gaps Framework for Analysis Enhancing Protection of Refugees

This Framework for analysing gaps in protection capacity was developed in the context of the Strengthening Protection Capacity Project (SPCP). Initially funded by the European Commission and three co-funding States, the SPCP seeks to strengthen the capacity of States to protect refugees and others of concern. It uses a comprehensive and collaborative approach to capacity building that involves all concerned stakeholders in the identification of protection gaps and the development of projects to remedy them.

UNHCR Note on Diplomatic Assurances and International Refugee Protection

This UNHCR Note addresses issues and concerns related to international refugee protection which arise where States rely on diplomatic assurances in the context of the transfer of a person from one State to another. It provides an overview of States' non-refoulement obligations under international refugee and human rights law as well as customary international law and analzyes their implications for the use of diplomatic assurances where the person to be removed is a refugee or asylum-seeker. The Note also examines the impact on the determination of eligibility for refugee status in cases where diplomatic assurances have been given with regard to an asylum-seeker and sets out UNHCR's position on a number of procedural and substantive questions which arise in this context.
